To be more specific: if you're a woman, and if your child is unborn (or, according to Senator Obama, if he has survived an abortion), the state is uninterested as to whether or not you contract for his killing.
BUT, once the child is born, he belongs to the state.
What stands out in what I've read so far of this is that the judge does not particularly express concern about whether or not the children are learning to read, to write, nor other whether they are mastering other academic skills. No, it's all about social engineering, controlling and forming the beliefs and values of the child.
He speaks as someone writing twenty-five years ago and utterly ignorant of homeschooling. Or longer ago than that, and in another country. The 2nd Appellate Court in Los Angeles agreed with the trial court decision that had found, "keeping the children at home deprived them of situations where they could interact with people outside the family".
"There are people who could provide help if something is amiss in the children's lives, and they could develop emotionally in a broader world than the parents' 'cloistered' setting," the ruling said.
The words echo the ideas of officials from Germany, where homeschooling has been outlawed since 1938 under a law adopted when Adolf Hitler decided he wanted the state, and no one else, to control the minds of the nation's youth.Ah, life in The People's Republic of California.Wolfgang Drautz, consul general for the Federal Republic of Germany, has said "school" teaches not only knowledge but also social conduct, encourages dialogue among people of different beliefs and cultures, and helps students to become responsible citizens."

This story has been on a number of blogs that I read. I was disappointed that so many people who say they are Christians, know the laws of California, set-up "schools" made up only of their kids and knowingly just break the law. I guess I am the only one that feels that way. I feel people should work to change the law and not get all bent out of shape when they can't just do whatever they want. (And for the record, I believe it is a terrible law.)
I'm not a lawyer, so I don't know if I'm reading the decision correctly, but is the CA appeals court saying that children must be enrolled in a private or public school and unless the parent has a valid teaching credential then then they cannot homeschool their children?
That sounds pretty sweeping because that means parents parents have to hold a credential for the grade being taught. Easier to do with elementary school, but when you get to secondary education, unless parents get a credential on English, Math Physics, Chemistry, etc. etc. etc. and every other possible secondary subject, it's darn near impossible for any parent to homeschool their children.
Graydave,
Given what the educational institutions have become, teaching kids that Sally has two moms, evolution, etc., parents have a duty, if they so desire, to break the law and not have their children in public schools. I'm not a parent, but given the awesome responsibility that parents have on kids' impressionable minds, I don't know if I would want my kids bombarded with notions that homosexuality is okay, evolution is law, and how to be a good democrat and liberal. But that's just me.
What stands out in what I've read so far of this is that the judge does not particularly express concern about whether or not the children are learning to read, to write, nor other whether they are mastering other academic skills. One of my friends who homeschools passed the link of a petition you can sign.

I really feel bad for you homeschoolers.
Graydave,
I believe you are seriously doing a disservice and misrepresenting your brothers and sisters in Christ. You are also misrepresenting the law.
My wife saw this on Al Mohler's blog this morning. This is a frightening prospect for those of us expecting a child in a blue state.
We also have friends in Germany whose police crackdowns in certain counties have intensified recently. Please pray for Protestant parents in that country.

I haven't read the law, only this:
"Yet the appeals court said state law has been clear since at least 1953, when another appellate court rejected a challenge by homeschooling parents to California's compulsory education statutes. Those statutes require children ages 6 to 18 to attend a full-time day school, either public or private, or to be instructed by a tutor who holds a state credential for the child's grade level."
I should have waited for all the information to come out before commenting. I was just giving my initial reaction to what seemed like people trying to get around the law by registering dummy schools.
This is the first time in a long time that a judge has interpreted the law to say anything even resembling this. It is WAY out of bounds, and beyond the judges jurisdiction.
Schwarzenegger denounces 'outrageous' homeschooling ruling
Correct me if I am wrong Dan, but isn't it true that one does not even have to have teacher's credentials to teach in Calif. due to a desperate need for teachers? I thought I heard that they accept persons with degrees and then they are allowed to work toward their credentials later. If so, I find it ironic that they require homeschool parents to have teacher's credentials.
Hi Candy,

No, teaching credentials are required.
As for the issue at hand...I got an email from my pastor about it, and to click on a petition to stop it. I was shocked at first of the news, but then I realized...wake up Gilbert, what did you really expect when you put those in charge who hate God, and then how do you expect the devil to work in them as elected officials? This isn't rocket science...we know the devil's wicked ways.
But I have to admit, I still look at how God says freedom is found in Christ...and when you deny Him, the Father, the Spirit...you put yourself in bondage, and desire to do that to everyone else.
Man. Aren't you glad we don't have to deal with this nonsense in heaven?
Yes, it is totalitarian authoritarianism. Yes, Hitler, Mussolini (who imprisoned Gramsci, an Itallian communist, who is along with Americans Dewey, Thorndike, Mann a great hero of the NEA's central government education programs) had mandated state programs of education for the very purpose of indoctrination, but it is a story as old as time. John Addams wrote his wife Abigail that we needed a national education system so that the children would be inculcated in the ideals of the state because the parents could not be trusted to do so.
It is not a new mentality. John Dewey devised an educational system from which his terminology was coined "education as change agent." Change, change, change, the ever evolving species known as education will produce a perfect man, sound familiar? He knew, as a proto-fascist what has been the case from time one, "Teach these things to your children so that they will teach theirs." Interesting how the enemy adapts God's principles to advance his own agenda, eh?
Who cares though? The attitude of the "Christian community" was put on public display when the SBC refused to even issue a resolution calling for pulling Christian children out of the public schools.
Check your church constitution it may be in there. It was in my former SBC church's; the education clause. Check the BFM: "Christianity is the faith of enlightenment and intelligence. In Jesus Christ abide all the treasures of wisdom and knowledge. All sound learning is, therefore, a part of our Christian heritage. The new birth opens all human faculties and creates a thirst for knowledge. Moreover, the cause of education in the Kingdom of Christ is co-ordinate with the causes of missions and general benevolence, and should receive along with these the liberal support of the churches. An adequate system of Christian education is necessary to a complete spiritual program for Christ's people."
By their own confession, they make education- academic education- part of the mission work of the church. But, what they do is damn their kids to the public arena with the super spiritual excuse that they are sending their kids to be salt and light. This is in spite of the fact that most kids graduating from secular highschools will abandon their faith, never to return. We lose far more than we ever win.
Here then is the call. For a while Christians controlled the secular systems, in violation of the very constitution that they so dearly love. The power has shifted. The same philosophy of education prevails: whoever is in power controls what will be taught. Christians have lost the power of the state, but, they have the power to remove their children and a right to oppose the government if it imposes upon the precepts of Scripture. The question is who has guts enough to refuse the meat of the king's table. Then again, if Christians wish to retain the services of the state to take care of the less gifted and poor among them, the question is moot.
You see, way back there in the captivity, Daniel and the faithful band refused the training table of the pagans, for just this very reason. Yes, there will be persecutions, imprisonments, fiery trials. What remains is: who is willing?
Tell your church, tell your association, tell your convention: these are the Lord's children. Tell the priests to raise the trumpet to their mouths and gather the people for battle, lest while you sleep the enemy overruns the camp.
If it is not too late already.
Preemptive strike-, accusations of fundie separatism will be rejected out of hand. That objection is already answered by those who support homeschooling. For, what is homeschooling but separatism? Aggressive academic pursuit with engagement of society is not an oxymoron. I would argue that as long as Chrisitians continue to enroll their children in public school, the Christian voice will be silenced. Equity will only be achieved with parity.
Strong Tower wrote: "I would argue that as long as Chrisitians continue to enroll their children in public school, the Christian voice will be silenced. Equity will only be achieved with parity."
I don't know if that is true. But I'd like to make a few comments on why the schools are spending time social engineering - I think in part it's because of their liberal agenda all part of Satan's plan and what have you, but I think in part it is a response to the failed child rearing by many parents (also Satan’s plan).
It is a very sad, sad reality that many parents in our society are failing miserably in child-rearing. You look at the violence that is being done against, e.g. homosexuals, or some minorities, or fat kids, or you name it, many parents are failing in the child-rearing, and the effects are showing up in the schools. And since the family is failing and these kids are showing up in the schools, there is some obligation that the schools believe they have. I mean, you just can't have kids going around committing violent acts or acting belligerent, or exhibiting some kind of serious negative behavior.
And that's where the schools come in with the social engineering. So, we can't have homosexual kids or teens or what have you being beaten up, or we can't have children of let's say homosexual parents being ridiculed, so what do the schools do, they teach that homosexuality is okay and it is just a natural and good part of life for some people. So, rather than parents disciplining their children against acts of violence, parents have simply reneged their responsibility and the schools are "stuck with the bill" and forced to employ their own social engineering.
So, while I agree that you have in the public schools the influence of an anti-Christian worldview (evolution, non-traditional family, etc.) and you have the danger of ungodly influence of wicked kids, it's important to note that public schools weren't always this way and I believe it was perhaps Satan's craftiness in working to destroy the family and working in families to renege their childrearing responsibilities leading schools to employ their wicked social engineering methods (e.g., it's okay that you're homosexual, or it's okay that you have two mommies or it's okay to have premarital sex - just protect yourself, etc. etc. etc.). So, what the public schools have become is really an indictment , I think, on the American family including the professing evangelical family.
Carlo-
Some things you say I would agree with, however you said: "So, rather than parents disciplining their children against acts of violence, parents have simply reneged their responsibility and the schools are "stuck with the bill" and forced to employ their own social engineering."
Have you spanked a child in public lately? Have you tried to have a child committed to the state reform school for disobedience? Right, because those options have been taken away from parents, not because parent wanted others to do it, but the old ways were deemed inappropriate by the educational/psycholocical establishment. Do you know, that each of the men that I mentioned that were educators, were also psychologists? You see, the myth that it is the family which is to blame is just that, a myth. Propaganda sent out for the NEA party headquarters. Policies that have been established, which are now entrenched in the schools, have been generations in the making by the single most power lobby in the U.S., which in reality is the power behind the DNC. Even when parents are diligent to discipline there kids at home, when they send them to school, the entire authority stucture and often belief system, is different and opposed to them. Chaos and conflict is bred by the system. There is an aggressive distain for parenting. We are portrayed by media and educators alike as too stupid to discipline, and surely too stupid to educate. There is no wonder why children are a discipline problem when the conflict of interest is encouraged by the schools.
The problem is, it is about control. I have witnessed the teachers in their lounges and their put downs of parents. It is systemic. Teachers who are for the most part the most poorly educated of all licensed professionals, can you dig it, putting down parents who by and large are far better educated than they. Why? They are given their marching orders from the "Union". What they know, and what they believe is in their magazines and books, in their classes and their political/labor unions. Those unions were formed by Horace Mann, and John Dewey, both proto-facist socialists. The enshrined heros of the NEA. Believe it or not. The PARTY is alive and well and did not die out with the big boss unionism of the, check it out, late 19th and early twentieth centuries.
Little known fact. In the early years of the Reich, open sexuality was encouraged. Homosexuality flourished (remember the Cabare' ol chum?). Psychological evolutionism was at its heyday, and the experts were all too willing to tell the peons that they were all wrong. Christian's authority of Scritpure was over-thrown, and children were set against their parents authority by the state's usurpation of it. The Californian dictum follows from an ideological belief that children are the property of the state, and that it is the state that has proprietary right to bring up the children as it sees fit. Several court cases, even the U.S. Supremem Court have reversed what was the historic precedent, that parents have inherent rights to raise their children. This California case is just one more nail in the coffin of retracing the steps leading to the rise of facism's death grip on Europe. The only thing in reality that separates the U.S. from them then and us now, is an ocean and time, or we would have gone down the same path years ago. You must note that it was Luther's and Calvin's Europe, and not some pagan world that just happened to get caught up in a revolution.
The state no longer supports the parent. And, yes the households are out of control. But, I would not be so quick to condemn them. There is more to the picture of the family than the NEA, the NAS or the APA would have you to believe.
Once the social morals had been broken down by the fascists, once the Christian heritage was overthrown, once the panic of social unrest established, the trap was sprung. Restrictive prohibitions were put in place by Goeringesque policies. The disfunctional rounded up and done away with to establish the utilitarian order that was dreamed of by those who believed that most of us are just too stupid to teach our own children at home.
Goering engineered the purgings. Likely of Jewish decent himself. One of his operations was to eliminate Rohm's SA Storm Troopers. Rohm's Officers were homosexual. Goering put them and all their minions to death. A minion is a small effeminate boy. From that point on, the homosexual was hunted down by the SS.
The undermining and systemic failure in the schools is planned, I am convinced. Perhaps not by humans, perhaps it is demonic. But, it does not matter, for it is what it is. In the final analysis we cannot stop it, but we can oppose it.
But, don't take up the popular chant that it is the parents that are to blame. That is what Hitler got the youth to do as they marched down the street in their little brown camp jerseys. In many, if not most cases, parents no longer know what to do, nor do they have the power to do so if they did.
